General Terms and Conditions

1. Website
   • The website www.alphashooting.hu – hereinafter referred to as the Website – is operated by – hereinafter referred to as the Operator – Alpha Shooting Range Kft. (registered office: 2377 Örkény, inner-city sports complex 2502/2., company registration number: 13 – 09 – 230860, tax number: 32426850-2-13).
2. Acceptance of General Terms and Conditions
   • These general terms and conditions – hereinafter: GTC – contain the description and conditions of use of the services – hereinafter: Service – that can be ordered online on the Operator’s Website. The GTC contains, among other things, the provisions on the conclusion of the contract – hereinafter: Contract – for the performance of the Service selected by the customer – hereinafter: Customer –, the performance of the concluded Contract, and the termination of the Contract.
   • By registering on the Website, the Customer accepts the terms of these GTC. The provisions of the GTC published on the Website shall apply even if the Customer uses the Website from a mobile device or uses a version of the Website optimized for mobile devices.
   • If the Customer orders the Service for more than one person, i.e. concludes the Contract on behalf of more than one person and accepts the provisions of the GTC, the contracting parties shall consider that the persons represented by the Customer have become familiar with and accepted the provisions of the GTC and, knowing the GTC, have authorized the Customer to conclude the Contract. By authorizing the Customer to conclude the Contract, the persons represented by the Customer have waived their right to subsequently challenge the Contract because they were not familiar with the provisions of the GTC.
3. Data protection
   • By opening the Website, the Customer consents to the processing of their data.
   • The Operator pays great attention to the protection of the Customer's personal data. When visiting the Website and using the Services on the Website, the Operator will do everything in its power to protect the Customer's personal data while visiting the Website. However, the Operator must also take into account its own legitimate interests, which determine the type and amount of data necessary for visiting the Website and using the Services on the Website. The amount and type of data that the Operator becomes aware of depends on how the Customer uses the Website.
   • The Operator pays special attention to ensuring that, during its data management, it acts in the interests of the Customer in accordance with the GDPR, Act CXII of 2011 on the Right to Informational Self-Determination and Freedom of Information, and the practice developed during the activities of the National Data Protection and Freedom of Information Authority. The Operator's data protection and data management policy can be accessed via the alphashooting.hu website.
4. Available services
   • The Services that the Customer can order from the Operator are listed on the Website. The Services and educational bundles offered by the Operator are referred to on the Website as bundles – hereinafter referred to as Bundles.
   • The description of the Bundles displayed on the Website – including the price of each bundle – is for informational purposes only and reflects the status valid at the time of viewing.
   • If the Customer requires additional or different services in addition to the Bundle listed on the Website, he must request a separate offer from the Operator and in each case must conclude a separate contract with the Operator.
   • The Operator does not guarantee the continuous availability of all Bundles. The Operator reserves the right to unilaterally modify the composition of the Bundles it offers from time to time, including permanently removing certain Bundles from its offer. The Operator excludes liability for damages if the composition of the Bundles changes during the performance compared to the ordered Bundle.
   • The Operator has the right to set an upper limit on how many people can order a given Bundle at the same time, and how many people can be at the Shooting Range at a given time.
   • The Services offered by the Operator may only be used by persons over the age of 18. An exception to this is persons over the age of 16 who have a sports club membership in a shooting sports club and who also have a valid competition license issued by a national professional association.
5. Registration
   • The Customer is only entitled to order Bundles and compile a “shopping list” by registering. During registration, the Customer creates a customer account and is responsible for transactions initiated from his customer account. The Customer is obliged to keep the password created during registration confidential.
   • The Customer undertakes to ensure that during registration a) the personal data provided by the Customer is true, accurate and complete, b) they immediately modify their data if there is a change in their data, c) they do not register on the site in the name of another person, do not use a false name or a name for which they do not have a legal basis.
   • The Operator excludes liability for any damage incurred by the Customer because the Customer has given the password of his/her account to a third party or because a third party has obtained it from the Customer.
   • If the Customer does not log in to the account created during registration within 365 days from the date of registration, the Operator is entitled to delete the Customer's registration (and thus their account).
   • The Operator is entitled to immediately delete the Customer's registration (and thus their account) if there is reason to believe that the Customer has violated the provisions of the GTC.
6. Formation of a contract
   • The Contract between the Customer and the Operator is not concluded by the Customer ordering the Service (Package) selected by the Customer, but by the written confirmation of the Customer's order by the Operator. The contract between the Customer and the Operator is automatically concluded by sending the confirmation to the email address provided by the Customer upon registration. The contract concluded between the Customer and the Operator is concluded at the price (contract price) and with the content with which and at which price the confirmation was made to the Customer.
7. Contract fulfillment
   • The Operator shall perform the service ordered by the Customer at the shooting range operated by the Operator – hereinafter referred to as the Shooting Range. The address of the Shooting Range is: 2377 Örkény, belterület sporttelep 2502/2.
   • The Operator will perform the service ordered by the Customer on the day specified in the confirmation, within a time frame calculated from a starting time.
8. Prices
   • The price of the Bundle includes VAT. The price of the Bundle is per person and per package. The price of the Bundle includes the cost of safety equipment (eye and ear protection) and the use of the weapons offered in the Bundle, the cost of mandatory theoretical and practical training, the cost of the ammunition offered in the Bundle and the shooting range guide fee. The price of the Bundle does not include the cost of getting to the Shooting Range; the Customer must arrange for the cost of getting to the Shooting Range and bear the costs thereof.
   • The Operator has the right to change the prices displayed on the Website at any time. For orders in progress, the price displayed at the time of ordering shall apply.
9. Payment terms
   • You can pay for the Services and Packages offered on the Website at the time of ordering, by prepayment, bank card, bank transfer or online payment.
10. Withdrawal from contract
    • The Customer may withdraw from the contract concluded with the Operator at any time.
    • If the Operator receives the Customer's cancellation notice 72 hours before the date of performance, the Operator will charge an administration fee of HUF 6,350/person. The Operator will include the administration fee in the fee to be refunded to the Customer. The Operator will transfer the remaining amount of the Package price to the bank account provided by the Customer.
    • If the Operator receives the Customer's cancellation notice within 72 hours before the date of performance, the Operator is entitled to include the full contractual price of the Package or Packages in the fee paid by the Customer as compensation and administration fee.
    • The Customer may only withdraw from the ordered Service in writing. A further condition for withdrawal is that the Customer receives the Operator's declaration of withdrawal. The Customer must send his declaration of withdrawal to the email address iroda@alphashooting.hu or hand it over to the Operator in person at the Shooting Range reception. The Operator will not accept a declaration of withdrawal sent by letter. The Customer's declaration of withdrawal shall be legally effective from the day on which the Operator received it, with the proviso that declarations of withdrawal received after the Shooting Range's opening hours shall only be legally effective from the next opening day. The Shooting Range's opening hours are included on the Website.
11. Termination of the contract
    • The Operator is entitled to terminate the Contract with immediate effect, in particular, but not exclusively, if the Customer disrupts the operational order of the Shooting Range, violates the rules of conduct prescribed in the Shooting Range's operational regulations - hereinafter referred to as the Operational Regulations -, if the Customer does not cooperate with the employees at the Shooting Range, if the Customer violates the rules of weapon handling, if the Customer does not demonstrate sober and responsible behavior during the performance of his/her duties, or if the Customer arrives at the Shooting Range under the influence of alcohol or a substance (including medication) that adversely affects his/her judgment or consumes alcohol or a substance (including medication) that adversely affects his/her judgment at the Shooting Range, if the Customer's health condition adversely affects or limits the Customer's judgment in any way, if the Customer registers with false data during registration, or cannot credibly prove the data provided during registration with documents.
    • The Operator is also entitled to terminate the Contract with immediate effect if the Customer fails to fulfill its payment obligations under the GTC and the Contract, either partially or not at all, by the deadline agreed upon in the GTC and the Contract. In the event of a breach of payment obligations, the Operator's right to terminate shall commence on the day on which the Customer should have fulfilled its payment obligations.

    • The Operator's right to terminate the contract with the given Customer with immediate effect is at the Operator's discretion, and the Operator is entitled to implement its decision immediately.
    • If the Operator has terminated the Contract with immediate effect, the Customer may not use the ordered Service. If the performance of the ordered Service has begun, the Operator shall immediately terminate the performance of the Service upon termination of the Contract. If the Operator terminates the Contract with immediate effect, the Customer shall be obliged to leave the Shooting Range area by the shortest route and within the shortest time.
    • If the Customer against whom the Operator has terminated the contract arrived at the Shooting Range as a member of a group, the Operator is entitled to suspend the performance of the service for all members of the group until the person affected by the termination of the Contract leaves the Shooting Range. If the duration of the suspension exceeds 15 minutes, the Operator is entitled to terminate the Contract with immediate effect for all members of the group.
    • If the Customer does not appear at the start time of the ordered Service (is late), the Operator reserves the right to perform the Service ordered by the Customer at the price stated in the original contract, but in a shortened time frame and with reduced content.
    • If the Customer arrives 15 minutes later than the start time of the ordered Service, the Operator reserves the right to terminate the Contract between the Customer and the Operator with immediate effect.
    • In the event of immediate termination, the Operator is entitled to include the full contractual price of the Package or Packages in the fee paid by the Customer as compensation and administration fee.
12. Image, film and audio recording
    • The Customer is only entitled to take pictures and film recordings in the Shooting Range area in the zone designated by the Operator. If the Customer takes recordings outside the designated zone, he is obliged to delete the recordings from his device immediately upon being requested to do so. If the Customer fails to comply with the Operator's request, the Operator is entitled to terminate the Contract concluded with the Customer with immediate effect.
    • If the Customer has arrived at the Shooting Range as a member of a group, the Operator is entitled to suspend the performance of the Service for all members of the group until the Customer deletes the recordings from their device. If the duration of the suspension exceeds 15 minutes, the Operator is entitled to terminate the Agreement with immediate effect for all members of the group.
    • In the event of immediate termination, the Operator is entitled to include the full contractual price of the Package or Packages in the fee paid by the Customer as compensation and administration fee.
    • The Customer acknowledges that the activities taking place in the Shooting Range may be filmed and photographed. Therefore, by entering the Shooting Range, the Customer consents to the filming and photographing of the Customer at the Shooting Range.
    • The Customer acknowledges that the Operator will retain and store the recordings made at the Shooting Range for the period specified by law, and in the event of a statutory obligation, will forward these recordings to an organization or authority with a legal basis for this. By entering the Shooting Range, the Customer waives all rights based on which he could make any claim or enforce any right against the Operator due to the recordings made of the Customer.
13. Compensation
    • The activity at the Shooting Range is considered a dangerous operation, therefore the Customer is under an increased obligation to cooperate with the Operator and to fully comply with the Operating Rules prescribed by the Operator. In the event of damage, the Customer is obliged to compensate the injured party for the damage caused.
14. Modify website content
    • The Operator reserves the right to temporarily suspend or permanently terminate the Website or parts thereof without prior notice. The Operator is entitled to remove any content posted on the Website by any third party from the Website without prior notice or justification.
    • The Operator takes the utmost care when creating the content of the Website and does everything in its power to ensure the accuracy of the data content of the Website. Nevertheless, the Operator does not guarantee the accuracy and reliability of data and information received from others regarding the Service on its Website, and therefore the Operator excludes all liability for damages caused to others by incorrect data.
    • The Website may contain links that lead to other websites that are not under the control of the Operator, therefore the Operator assumes no responsibility for the content of the data on such websites.
    • The Customer undertakes not to post offensive, obscene or otherwise objectionable content on the Website during the use of the Website.
    • The Customer undertakes that when visiting the Website: a) he/she will not disturb and/or hinder others from using the Website; b) he/she will not modify the content of the Website or change its technical nature in any way; c) he/she will not disrupt the security of the Website; d) he/she will not use the Website to send unsolicited messages (spam) or chain messages, he/she will not send viruses or dangerous or malicious programs to the Website; e) he/she will not create fake messages for the purpose of falsifying the identity of a customer or in order to gain access to another customer's account.
15. Miscellaneous provisions
    • Minors with limited legal capacity (children between the ages of 14 and 18) may only be present in the Shooting Range in the presence of their legal representative and with their written permission, and only as an escort.
    • Incapacitated minors (children under 14 years of age) are not allowed to enter the Shooting Range area, even with their legal representative or with the permission of their legal representative.
    • The Parties agree that the application of the Customer's own general terms and conditions of contract is excluded when applying the legal relationship specified in the GTC.
    • If there is a discrepancy between the Hungarian and English versions of the Website's content, the Hungarian version shall prevail.
    • The Operator reserves the right to unilaterally amend the provisions of the GTC at any time. The amended GTC shall enter into force upon publication on the Website. The provisions of the GTC in force at the time of use of the Website shall apply to the Customer.
    • If certain provisions of the GTC are invalid, the invalidity of the given provision shall not affect the other provisions of the GTC, which shall remain in full force and effect.
    • By accepting the GTC, the Customer expressly waives the right to set-off against the Operator in the event of any claim it may have.
    • The Operator is entitled to transfer its rights and obligations arising from this contract to a third party.
    • The Operator's failure to exercise or delay in exercising any right shall not constitute a waiver of such right or claim. No conduct of the Operator, except for a clear written statement to that effect, shall constitute a waiver of any right or claim.
    • The law of Hungary shall apply to issues and disputes arising from the legal relationship regulated in these GTC. In the event of any legal dispute between the parties, the jurisdiction of the court at the registered office of the Operator is stipulated.
